Terms of Use

This is an English translation of the Japanese original, which is the version shown in the app. If the two differ, the Japanese version prevails.

These Terms of Use (these "Terms") set out the conditions for using the iOS and iPadOS app "Himel Agent" (the "App") provided by Philiaxis (representative: 中居 里瑛; "we" or "us"). By using the App, you are deemed to have agreed to these Terms.

Effective date: October 30, 2026

1. About the App

The App is an AI agent that thinks using one of the following: a model on your device, a cloud AI you have registered, or a DeepSeek Harness (DSH) server you have set up. If you obtained the App from the App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies, together with these Terms.

2. Age requirements

  1. The App is intended for people aged 13 and over. If you are a minor, use the App with the consent of a parent or guardian.
  2. You enter your date of birth at first launch. It cannot be changed later. You must enter your correct date of birth.
  3. Hugging Face search and adding models from a URL or a file are limited to people aged 18 and over.

3. Outside services

  1. You use outside services such as cloud AI, web search and DSH servers under your own agreements, API keys and servers. Fees are governed by your agreement with each service, and we do not bear them.
  2. You must comply with the terms of service and usage policies of each service.
  3. We are not the provider of these services and are not responsible for their provision, suspension or changes, or for how they handle the information you send.
  4. Company names, product names and logos shown in the App are trademarks of their respective owners. The App is not affiliated with or endorsed by those companies.

4. AI replies and actions

  1. AI replies may contain errors, outdated information, bias or inappropriate content. Check the content yourself before making important decisions.
  2. Do not use the App as a substitute for professional judgment, such as medical, legal, tax or investment advice.
  3. Actions in which the AI acts on the outside world, such as web searches, fetching web pages and running commands in DSH, are carried out based on your approval or settings. You are responsible for their results.
  4. Models used on your device, including the bundled LFM3 (LFM Open License v1.0), are subject to their own licenses and terms of use. Before downloading a model, check its source and license on its details screen.

5. Prohibited conduct

You must not use the App to:

  • break the law or act against public order and morals, or encourage crime
  • infringe the copyrights, trademarks, privacy, reputation or other rights of others
  • create content that sexualizes children, sexual images or text of a person without their consent, or content that discriminates against, threatens or harasses a particular person or group
  • create false information meant to deceive others, or content that impersonates someone
  • use outside services in ways that violate their terms, or place an excessive load on them

6. Reporting inappropriate replies

You can report an inappropriate reply to us by long-pressing the reply or using 報告 (Report) under it. We will review the content and, where necessary, revise the default settings or features of the App. How information sent in a report is handled is set out in the Privacy Policy.

7. Rights

  1. The source code of the App is published under the MIT License. Rights to third-party software, fonts and models bundled with the App belong to their respective owners and are subject to the licenses shown in 設定 (Settings) › オープンソースライセンス (Open source licenses).
  2. What you enter and the replies you obtain through the App are governed by your agreements with each outside service. We do not acquire any rights to them.

8. Disclaimer

  1. We do not guarantee that the App will suit your purposes, be accurate, or be free from interruptions or defects.
  2. We are not liable for any damage you suffer from using the App, except where it is caused by our intentional misconduct or gross negligence.
  3. Even where the preceding paragraph does not apply because of the Consumer Contract Act or other laws, our liability is limited to ordinary damages that you actually incur.

9. Changes and termination

We may change the App or these Terms, or stop providing the App. When we change these Terms, we will announce it in the App and on the published page, and by using the App after the announcement, you are deemed to have agreed to the changes.

10. Governing law and jurisdiction

These Terms are governed by and interpreted under the laws of Japan. The district court with jurisdiction over our location has exclusive jurisdiction as the court of first instance for any dispute relating to the App.
